Records fail to link Tunoi, Kidero to bribery scene

Suspended Supreme Court justice Philip Tunoi sent two text messages to Geoffrey Kiplagat according to details captured by mobile provider, Safaricom.

The information provided by Inspector of Police in the Directorate of Criminal Investigations Monica Githaiga indicated that the two made contact on June 26, 2014.

While the content of the messages could not be verified, Githaiga said Kiplagat, who accused Tunoi of receiving Sh200 million from Nairobi Governor Evans Kidero sent a total of nine messages to the judge on the same day.

“We were, however, unable to retrieve the messages as Safaricom informed us that they do not store messages,” she said while testifying before the Sharad Rao-led tribunal. The revelation comes against Tunoi’s claims that he has never met Kiplagat and accused him of being used to fix him.

The mobile provider also showed back and forth interaction between Kiplagat, Katwa Kigen, the governor’s personal assistant John Osogo and Nairobi businessman Michael Njeru.

In one of the instances, Githaiga, who is attached to Kiambu Unit said that the analysis established that Kiplagat sent Njeru a text message while located at National Housing Corporation (NHC) in Nairobi’s Madaraka estate.

But Safaricom did not capture some of the voice calls and messages that Kiplagat alleged to have taken place in his affidavit signed on November 22, 2014.

Githaiga however disclosed that mobile phone service provider Airtel is still in the process of availing information on a line registered under the name of Tunoi’s son, Anthony Tunoi. “I have had difficulties accessing the information that was required in the year 2014 but  I am still following the matter I will get details in due course,” she said.

Safaricom records could also not link Kiplagat, Kidero, Tunoi, Kigen and Kiprop Chirchir to the scene where the Sh200 million alleged bribe exchanged hands.

While Kiplagat’s affidavit indicated that the five met at a petrol station on Waiyaki Way, the archive by the mobile provider shows that they were in different locations on August 27, 2014 between 7 and 9pm.

“Kidero was at North Muthaiga, Tunoi was captured to be at St. Ellis opposite Supreme Court and Kileleshwa, Kiplagat at Madaraka NHC, Chirchir was at Kilimani and Kigen operated between St  Ellis and Menellik Hospital in Kilimani,” said Githaiga.
