Aladwa to appear in court

Nairobi ODM chairman George Aladwa.

The court has issued summons against former Nairobi mayor George Aladwa to appear before it on Friday to answer incitement charges. This was after Director of Public Prosecution (DPP) made an application before Nairobi chief magistrate Daniel Ogembo to summon the Nairobi ODM chairman to take plea on Friday.

Aladwa faces an answer to incitement to violence charge over remarks he made at a public rally in Kibera. He was arrested, but freed on Sh20,000 bail after his lawyer petitioned the High Court.

Justice Joseph Onguto had directed that Aladwa continue enjoying the police cash bail pending the completion of investigations. Justice Onguto also directed Aladwa to cooperate with investigators and appear in court whenever required.

Through lawyers Harun Ndubi, John Khaminwa and Anthony Oluoch, Aladwa pledged to honour summons to appear before the trial court whenever required by DPP. Justice Onguto granted the lawyers the request to file proposed petition within seven days while the respondents file their responses within 14 days for hearing and determination of the suit.

The DPP had opposed the application by Aladwa’s lawyers to be released on police cash bail. DPP had saidAladwa had not shown by cogent evidence infringement or threatened infringement of fundamental rights.

Aladwa had gone to court to file a case stopping police officers from charging him over statements described as offensive, that he made during the rally on Mashujaa Day, which led to his arrest October 23 at Railway club by CID officers.

He was released at 7.30pm, on October 23 after Ndubi secured a court order requiring police officers to release him on a Sh20,000 cash bail pending the hearing of his application on Tuesday.

In the video, Aladwa allegedly warns that rigging during the next General Election will plunge the country into bloodshed. However, Cord leader Raila Odinga has defended Aladwa’s remarks.
