Governors want the amendments to the Urban Areas and Cities Act of 2011 fast tracked in order to draw clear lines on classification and management of urban areas. Further, the county chiefs have opposed the recently proposed Community Land law, saying in its present form, it takes away community authority and powers of the counties to make decisions on matters of land adjudication.
Speaking at United Nations Office Nairobi (UNON) in Gigiri yesterday where they attended a one-day executive leadership conference, the governors set in motion, yet again a platform that is likely to generate another heated exchange with the national government.
They accused the national government of sitting on some of the important Acts that are direct ingredients of devolution. In the Urban Areas and Cities Act 2011, for instance, Kitui Governor Julius Malombe, who is also the Council of Governors’ chairman of the Urban Development Committee, wondered why the Ministry of Lands, Housing and Urban Development was still sitting on the proposals to amend it several months after it was reviewed.
He said the Act, being one of the legislations, which should have been enacted within the first year after the promulgation of the Constitution, had not taken off, but nothing had happened so far.
“The Transition Authority (TA) took an initiative to have the Act reviewed by all stakeholders, and now what’s required is for the CS Lands and Housing to take it to the Cabinet, and Parliament to be approved for enactment, but unfortunately that has not happened,” said Malombe.
