Orange Democratic Movement (ODM) party has sued the Independent Electoral and Boundaries Commission (IEBC) over a Gazette Notice dated December 7 that requires candidates for elective positions to appoint authorised persons and form campaign committees.
Under a certificate of urgency, the party claims that the decision by IEBC will lock out thousands of members of the ODM aspirants who have expressed interest or are yet to express interest for consideration as candidates for various elective positions.
Through lawyer, Anthony Oluoch, the Raila Odinga-led party also wants orders issued quashing the decision by the commission to publish Election Campaign Financing Guidelines on their website.
The Opposition states that IEBC submitted the guidelines to the Parliamentary Committee on Delegated Legislation and purported to come up with rules to regulate campaign financing.
“Section 5 of the Election Campaign Financing Act 2003 empowers the IEBC to make rules for the conduct of campaign financing but subject to the approval of Parliament and at least 12 months before an election,” said Oluoch in court documents.
