Kidero gets temporary orders to block ouster

Nairobi Governor Evans Kidero has obtained temporary orders blocking the County Assembly from proceeding with the process of his impeachment. High Court judge Roselyne Aburili issued the orders blocking the impeachment motion until the case is heard and determined.

The embattled governor sought a lifeline from the Judiciary against the decision to oust him as county chief over alleged violation of the Constitution and gross misappropriation of funds. Justice Aburili heard that the whole process was flawed and has effectively infringed on Kidero’s right to hold public office.

The ouster was perceived as a litmus test for Kidero and Speaker Alex Magelo as both engage in a plot to ouster each other. Cord affiliated Members of County Assembly (MCAs) have filed a motion to remove Magelo for approving the impeachment. A letter sent to Kidero last Thursday indicated that he was expected to appear before the Assembly in person this afternoon.

The Governor is also entitled to legal representation according to the invite. Jubilee MCAs had trooped to Naivasha over the weekend to strategise on modalities of pinning down the governor. “We have concrete evidence on some of the grounds cited in the impeachment motion,” said Minority Chief Whip Hashim Kamau. For the motion to sail through, 85 MCAs must support it.

Out of the 127 MCAs, 64 were elected on the ODM and Wiper tickets, while 63 are in Jubilee. On the other hand Magelo has come under intense pressure from Cord brigade who are the majority for approving Kidero ouster. According to the representatives, the Speaker was quick to approve the impeachment motion although he defended himself that he had followed the legal procedure.

“My work as Speaker is simple, to receive motions and petitions from members and even when I am the target and the Cerk approves it after meeting the required threshold I just approve and let the Deputy Speaker handle the session discussing me,” said Magelo.
