Nairobi businesswoman Esther Passaris yesterday lost a bid to compel the Registrar of Political Parties Lucy Ndung’u to register her Harambee Democratic Party.
The Political Parties Tribunal maintained that the registrar was within her rights to reject the party’s name.“The name Harambee is protected by the statute.
The registrar has not refused to register any other name,” ruled the tribunal. Passaris, through lawyer Maobe Maotsetung, had argued that the word Harambee is protected by the law, but not when used in conjunction with other words.
But Ndung’u said she only rejected the name, not the party. The name Harambee is protected under section 3 of the National Flag, Emblems and Names.
