Court rejects plea in Sh791m NYS scandal

Eleven suspects facing money laundering charges in the Sh791 million National Youth Service (NYS) scandal will now answer to the charges after a magistrate court declined to stop their prosecution.

Ben Gethi, his mother Charity Gethi, Josephine Kabura and lawyer Patrick Ogolla had filed an application to halt their prosecution. Nairobi chief magistrate Daniel Ogembo ruled that the orders sought by the suspects were similar to the ones dismissed by the High Court.

“The application by the accused persons seeks the same orders as that of the High Court. The magistrate court abides by the High Court order. I find no merit in the application thus it is dismissed,” he ruled.

Justice Ogembo said that there was no justification to stop the case and directed that suspects answer to the charges. A similar application was dismissed by Judge Joseph Onguto who ruled that money laundering charges are stand-alone charges and directed the accused to take plea at the magistrate court.
