Machakos Senator Johnstone Muthama yesterday got a reprieve after a Nairobi court terminated hate speech and incitement to violence charges against him.
Milimani chief magistrate Daniel Ogembo said the charges amounted to an abuse of the court process since Muthama was arrested last month and detained alongside five legislators for an offence committed last year while his co-accused cases were linked to utterances made this year.
Ogembo also said it was wrong for the Senator to face trial for charges similar to another case pending in court. He said the charges were not justifiable because the dates of arrest and that of the offence were also wrong and the prosecution can not account for the chronology of events before he was charged.
The Machakos senator was charged alongside MPs Junet Mohammed (Suna East), Timothy Bosire (Kitutu Masaba), Moses Kuria (Gatundu South), Ferdinand Waititu (Kabete), Kimani Ngunjiri (Bahati),Woman representatives Florence Mutua (Busia) and Aisha Jumwa (Kilifi).
