The government has disbanded the controversial Affirmative Action Social Development Fund (AASDF) over its constitutional deficiencies and is determined to formulate its replacement to cater for disadvantaged groups.
Already, the Treasury Cabinet secretary has sanctioned the National Government Affirmative Action Fund (NGAAF) Regulations, which will result in the creation of a social empowerment body to facilitate crucial programmes for the needy and less fortunate members of society.
The 47 County Women’s Representatives, who were patrons of their local committees, suffered a legal blow yesterday when High Court judge Joseph Onguto dismissed a petition by the Institute of Social Accountability (ISA) challenging the validity of the AASDF.
However, the Judge said that affirmative action programmes require members of disadvantaged groups to be offered preferential treatment.
“It is not in the interest of justice to pronounce on the constitutional validity of the revoked AASDF regulations 2015 or the NGAAF Regulations 2016,” Justice Onguto reasoned in his 21-page judgment.
