A group of ODM party leaders have threatened to move to court this week to seek orders declaring House Standing Order 111 which has been applied against Ugunja MP Opiyo Wandayi unconstitutional.
The MPs, majority of who walked out during the President Uhuru Kenyatta’s State of the Nation address, argued that Standing Order 111 is inconsistent with Article 47 of the Constitution and it is time the Order is rendered illegal and unconstitutional.
Led by the ODM party chairman John Mbadi, the lawmakers vowed to challenge the law and save Wandayi from the almost one year ban from carrying out his parliamentary responsibilities.
MPs Opiyo Wandayi (Ugunja), Gladys Wanga (Homabay MP), TJ Kajwang’ (Ruaraka), Florence Mutua (Busia MP), Junet Mohamed (Suna East), Simba Arati (Dagoreti North) and Homabay senator Moses Kajwang’ criticised National Assembly Speaker Justin Muturi of being biased in the manner he treated the Opposition.
They vowed to comb the hansard to expose instances when Jubilee MPs were let to go scot free after misbehaving before the floor of the house.
By kicking out Wandayi under Standing Order 111, the Ugunja MP is in effect locked out from any parliamentary activity for the remainder of the session. The fourth session of Parliament began on February 9 will end on the February 13, 2017.
