Terror convicts on death row to serve 15 years

The Court of Appeal has reduced the sentence for two Iranians jailed for life by a Nairobi magistrate’s court over terrorism-related charges to 15 years.

Justice Lukas Kimaru reduced the sentence for Ahmad Abolfathi Mohammad and Sayed Mansour Mousavi but declined to quash and acquit them as urged by their lawyer Kiraithe Wandugi.

Kimaru said the court had taken into consideration the fact that the appellants failed in their mission to perpetrate a terror attack in Kenya, adding that life imprisonment was not justified.

“The sentence is substituted by a consolidated sentence of this court sentencing the appellants each to serve 15 years. After completion of their sentence, they shall be repatriated to their home countries,” he said.

Justice Kimaru said the sentence will run since the day they were convicted. “It is clear from the evidence, the appellants were not acting alone or it was intended that they would be part of a group that would perpetrate a terror attack in Kenya. It is evident that the police nipped in the bud the intended terror attack.”

He commended the police for vigilance that saved citizens from the planned attack. The two were arrested in June 2012 after police found military-grade explosives at a golf course in Mombasa. They had been found guilty of three counts of terrorism related charges by a magistrate court.
